If you have or had a checking account with Park National Bank and you were charged certain overdraft fees between November 1, 2016, and February 20, 2025, you may be entitled to a payment from a Class Action Settlement.
A $510k Settlement has been reached in a class action lawsuit filed against Park National Bank (“Defendant”). The Plaintiff filed this lawsuit asserting claims against Defendant for breach of contract, including breach of the covenant of good faith and fair dealing, and unjust enrichment based on Defendant's alleged practices of assessing overdraft fees (“OD Fees”) in connection with debit card transactions that were authorized with a positive account balance, but purportedly settled with a negative account balance (the “APPSN Claims” or “the claims”). This is where a bank assesses an overdraft fee on a transaction that overdraws the account when it clears, although the transaction was previously authorized against sufficient available funds.
Defendant denies these legal claims. The Court has not decided who is right.
You are a “Settlement Class Member” if you come under the following Settlement Class definition:
APPSN Class: All Account holders who were charged one or more APPSN Fees during the Settlement Class Period.
If you are a Settlement Class Member, you do not need to do anything to receive a payment from the Settlement Fund so long as you do not opt out of or exclude yourself from the Settlement. Current customers of Defendant will receive a credit to their accounts for the amount they are entitled to receive. Former customers of Defendant shall receive a check from the Settlement Administrator. Class Members entitled to Overdraft Forgiveness shall receive this benefit automatically.
